Terms of Use
These terms are an agreement between you and Nicolas Frugoni, trading as Frusoft ("we"), for the Kwits app and website. By creating an account or continuing past the sign-in screen, you accept them and our Privacy Policy.
1. Who can use Kwits
You must be at least 16 years old and able to enter a binding agreement. You are responsible for your account and for what happens under it. Give us accurate sign-in details and keep your sign-in methods secure.
2. What Kwits is, and is not
Kwits is a record-keeping tool for shared expenses. Kwits does not hold, send or receive money. Marking a payment as paid only records that you and another person say it happened. We are not a bank, payment service or financial adviser. Balances are calculated from the entries members make, so check them before you pay anyone.
3. Your content
You keep ownership of what you add (expenses, comments, photos, names). You give us a limited licence to store, copy and show it to the members of your plans so the service works. Only add content you have the right to share, and photos of people only if they are fine with it.
4. Acceptable use and objectionable content
Kwits has zero tolerance for objectionable content or abusive behaviour. Do not use Kwits to:
- harass, threaten, bully or discriminate against anyone, or post hateful, sexual, violent or illegal content;
- post other people's private information, impersonate anyone or mislead people about money you owe;
- send spam, attack or probe the service, or use it for anything unlawful.
5. Reporting and blocking
You can report any comment, photo, expense or member from the menu next to it, and block a member so you no longer see their comments and photos. We review reports and act on them within 24 hours: removing content, and suspending or closing accounts that break these terms. You can also write to support@frusoft.dev.
6. Kwits Pro
Adding expenses, balances, joining plans and marking payments are free. Kwits Pro is an optional paid upgrade (monthly or yearly subscription, or a one-time purchase) sold through the App Store or Google Play at the price shown there. Subscriptions renew automatically until you cancel them in your Apple ID or Google Play settings, at least 24 hours before the period ends. Refunds are handled by Apple or Google under their policies. If Pro ends, you keep your data and your balances stay visible; only the Pro extras switch off.
7. Ending your use
You can delete your account at any time in the app or at /delete-account. What remains afterwards is described in the Privacy Policy. We may suspend or close accounts that break these terms or put others at risk.
8. Availability and changes
We work to keep Kwits running, but we do not promise it will always be available or free of errors. We may change features and these terms; if a change is significant we will tell you in the app. Using Kwits after that means you accept the change.
9. Our responsibility
Kwits is provided "as is". To the extent the law allows, we are not liable for indirect losses, or for disputes between members about money. Nothing here limits rights you have as a consumer that cannot be limited by contract, or liability that cannot be excluded by law.
10. Apple and Google
If you use the iPhone app, Apple's standard Licensed Application End User License Agreement also applies. Apple is not a party to these terms and has no obligation to support the app; Apple and its subsidiaries are third-party beneficiaries of the terms and may enforce them against you. Questions about the app, claims and support are ours to handle, not Apple's or Google's.
11. Law
These terms are governed by the laws of the country where Frusoft is established, without affecting the mandatory consumer rights of the country where you live.
